We are getting a lot of requests for certified copies of documents such as passports, driver's licenses, birth certificates, etc. A notary public in Tennessee is NOT authorized to certify copies and it is actually ILLEGAL for a notary to certify a copy of a vital document (such as a birth certificate). The way we do this in Tennessee is by using what is called "Copy Certification by Document Custodian".

This is specific wording that a notary public CAN notarize. It is essentially a statement that YOU are the custodian (owner) of a document and that you have sworn before a notary public under penalty of perjury that it is a true copy of the original. As a notary, I am notarizing the fact that you have sworn or affirmed before me that the copy is a true reproduction, NOT that I (the notary) am certifying the authenticity.

It would be greatly appreciated if you, the client, could prepare the copy with the appropriate wording BEFORE coming by our office or before we arrive at your location for an on-call notarization.

Have two "credible witnesses" with ID swear or affirm the signer's identity to the notary.
The witnesses must not be named in the document or benefit from having the document signed.
Unless you have a power of attorney that has been previously signed and notarized authorizing you to sign documents for the paralyzed person, no.
If the signer is able to sign in other ways (signs with their feet, mouth, etc and has done so for the majority of their life or substantial time following injury) that would generally be acceptable.
We require positive identification with A CURRENT GOVERNMENT ISSUED PHOTO ID.
This means it must not be expired.
2. We will not notarize if signers are coerced or appear to be signing under duress, nor will we notarize for those who are mentally incapable, under the influence of drugs (including sedating or otherwise mentally incapacitating prescription drugs), alcohol or other substances which impair the signer's ability to understand the documents or implications of signing.
This is for the protection of the signer and not necessarily the paying party.
A notary public does not need to know the back-story as to WHY a document needs to be notarized.
We just need to know the name or type of document.
The circumstances, as long as they are legitimate and not intended to defraud anyone, are irrelevant.
Family members calling on behalf of a hospitalized signer often feel the need to give every detail of why a form needs to be notarized and every detail about the signer's hospitalization.
We understand that in some situations people are stressed and often need to vent, but to respect the medical, financial and personal privacy of the signer or others involved we do not need all the additional information.
